These Event Organiser Terms and Conditions apply to all businesses, organisations, venues, accommodation providers, tourism operators, event hosts and individuals participating in Fleurieu Food Festival.
By submitting an application, purchasing a participation package, accepting inclusion in the festival program or participating in Fleurieu Food Festival, you acknowledge and agree to these Terms and Conditions.
1. About Fleurieu Food Festival
Fleurieu Food Festival is a region-wide food, wine and tourism festival delivered throughout the Fleurieu Peninsula during August each year.
The festival promotes independently operated events, experiences and tourism offerings delivered by participating businesses and event organisers.
Fleurieu Food Festival acts as a marketing, promotional and coordination platform and does not assume responsibility for the delivery of individual events unless explicitly stated.
2. Eligibility
Participation is open to:
Food and beverage businesses
Wineries, breweries and distilleries
Restaurants, cafés and hospitality venues
Accommodation providers
Tourism operators
Producers and growers
Event organisers
Community organisations
Arts and cultural organisations
Educational institutions
Other businesses approved by Fleurieu Food Festival
All proposed events must align with the objectives, values and quality standards of Fleurieu Food Festival.
3. Event Approval
Submission of an application does not guarantee inclusion in the festival.
Fleurieu Food Festival reserves the right to:
Accept or reject any application
Request amendments to event concepts
Require changes to event descriptions, imagery or marketing content
Reclassify participation packages
Remove events from the program at any time where required
Decisions made by Fleurieu Food Festival are final.
4. Participation Packages and Fees
Participation fees are payable in accordance with the selected package level.
Fees are non-refundable except where required under Australian Consumer Law.
Participation fees contribute to:
Festival marketing
Website management
Program production
Digital advertising
Public relations activities
Event administration
Tourism promotion
Festival coordination
Participation fees do not guarantee:
Ticket sales
Attendance numbers
Media coverage
Sponsorship opportunities
Commercial outcomes
5. Event Delivery Responsibilities
Participating organisers are solely responsible for the planning, management and delivery of their event.
This includes, but is not limited to:
Staffing
Venue management
Ticketing
Food and beverage service
Customer service
Event operations
Safety management
Risk management
Financial management
Regulatory compliance
Fleurieu Food Festival accepts no responsibility for event delivery.
6. Licences, Permits and Compliance
Event organisers are responsible for obtaining and maintaining all licences, permits and approvals required to operate their event.
This may include:
Liquor licences
Council approvals
Food business registrations
Development approvals
Event permits
Music licensing
Road closure permits
Traffic management approvals
Public health approvals
Fire safety requirements
Event organisers must comply with all applicable laws and regulations.
7. Insurance Requirements
All participating event organisers must maintain appropriate insurance coverage for the duration of their involvement in the festival.
Minimum requirements include:
Public Liability Insurance
Minimum $20 million public liability insurance coverage.
Workers Compensation Insurance
Where required by law.
Other Relevant Insurance
As appropriate to the nature of the event, including:
Professional indemnity
Product liability
Volunteer insurance
Motor vehicle insurance
Property insurance
Fleurieu Food Festival may request certificates of currency at any time.
Failure to provide requested documentation may result in removal from the festival program.
8. Ticketing and Customer Service
Event organisers are responsible for:
Managing ticket sales
Processing refunds
Handling customer enquiries
Managing booking systems
Communicating event information to attendees
Where ticket sales are facilitated through an approved Fleurieu Food Festival ticketing platform, organisers remain responsible for customer service and event delivery.
9. Event Changes and Cancellations
Event organisers must notify Fleurieu Food Festival immediately if:
An event is cancelled
An event is postponed
Event details change
Capacity changes occur
Ticket sales are suspended
Event organisers are responsible for communicating directly with ticket holders regarding cancellations, postponements, refunds or transfers.
Fleurieu Food Festival reserves the right to remove cancelled events from promotional channels.
10. Marketing and Promotion
By participating in Fleurieu Food Festival, organisers grant Fleurieu Food Festival, Fleurieu Peninsula Tourism and authorised partners permission to:
Promote their event
Use supplied event descriptions
Use supplied photographs and video
Use business logos and branding
Use event information in marketing materials
Use event information for media and tourism promotion
This licence is granted without compensation.
11. Marketing Content Requirements
Organisers warrant that all submitted content:
Is accurate
Is not misleading
Does not infringe third-party rights
Does not breach copyright
Is owned by the organiser or used with permission
Organisers indemnify Fleurieu Food Festival against any claims arising from submitted content.
12. Photography and Media
Organisers acknowledge that Fleurieu Food Festival may:
Attend events
Capture photography and videography
Invite media representatives
Share event imagery
Produce promotional content
Organisers grant permission for such content to be used for festival, tourism and promotional purposes.
13. Data Sharing and Privacy
Where attendees purchase tickets through festival-managed platforms, relevant attendee information may be shared with event organisers for operational purposes including:
Event communication
Attendance management
Customer service
Event delivery
Organisers must comply with all applicable privacy laws and must not misuse attendee information.
Attendee information must not be sold or transferred to unrelated third parties.
14. Event Quality Standards
Fleurieu Food Festival seeks to maintain a high-quality visitor experience.
Organisers agree to deliver events substantially in accordance with the information promoted.
Fleurieu Food Festival reserves the right to remove events that:
Damage the reputation of the festival
Generate significant attendee complaints
Breach laws or regulations
Fail to meet minimum quality expectations
Create safety concerns
14A. Minimum Event Delivery Standards
Participating organisers agree to deliver their event substantially in accordance with the information approved and promoted through Fleurieu Food Festival.
Organisers must:
Deliver the event on the advertised date and time unless otherwise approved.
Ensure sufficient staffing and resources are available.
Provide the products, services, experiences and inclusions promoted.
Maintain professional standards of customer service.
Ensure the event is presented in a safe, clean and welcoming manner.
Comply with all applicable health, safety and regulatory requirements.
Material changes to an event must be approved by Fleurieu Food Festival prior to publication wherever reasonably possible.
Failure to meet minimum delivery standards may result in removal from future Fleurieu Food Festival programs.
14B. Tourism and ATDW Content Licence
Where event information is submitted for inclusion in Fleurieu Food Festival, organisers grant Fleurieu Food Festival, Fleurieu Peninsula Tourism and their authorised partners a non-exclusive, royalty-free licence to use, reproduce, publish, distribute and modify submitted content for tourism and promotional purposes.
This includes:
Event descriptions
Images
Videos
Logos
Event details
Tourism listings
Accommodation information
Submitted content may be distributed through:
The Fleurieu Food Festival website
ATDW (Australian Tourism Data Warehouse)
South Australian Tourism Commission channels
Tourism Australia channels
Fleurieu Peninsula Tourism channels
Tourism publications
Media releases
Social media platforms
Third-party tourism and event promotion platforms
Organisers warrant that they hold all necessary rights and permissions for any content supplied.
14C. Marketing and Advertising Disclaimer
Participation in Fleurieu Food Festival provides access to coordinated regional marketing and promotional activities.
However, organisers acknowledge and agree that Fleurieu Food Festival does not guarantee:
Ticket sales
Attendance numbers
Revenue outcomes
Media coverage
Social media reach
Return on investment
Sponsorship opportunities
Commercial success
Any references to audience reach, impressions, website traffic, advertising exposure, media value or promotional activity are estimates only and should not be interpreted as guaranteed outcomes.
Premium, Featured or Enhanced Participation Packages provide additional promotional opportunities but do not guarantee specific results.
14D. Event Photography and Post-Event Content
To support future destination marketing and festival promotion, organisers agree to provide Fleurieu Food Festival with suitable post-event content upon reasonable request.
Where available, organisers may be asked to provide:
High-resolution event photographs
Event highlights
Attendance estimates
Visitor feedback
Testimonials
Media coverage
Social media content
Economic impact information
Organisers grant Fleurieu Food Festival a perpetual, royalty-free licence to use supplied content for future festival, tourism and destination marketing activities.
Appropriate credit will be provided where reasonably practicable.
14E. Sponsor and Commercial Partner Rights
Fleurieu Food Festival may enter into sponsorship, funding or commercial partnership arrangements that support the delivery of the festival.
Organisers acknowledge that certain sponsors, funding partners or commercial supporters may receive specific promotional benefits, branding opportunities, category rights or activation opportunities.
Participation in Fleurieu Food Festival does not grant organisers any exclusive rights within their industry category, product category or geographic area unless otherwise agreed in writing.
Fleurieu Food Festival reserves the right to determine the placement, visibility and promotional treatment of all participating events and businesses.
14F. Official Ticketing Platform
Where Fleurieu Food Festival requires events to utilise an approved ticketing platform, organisers agree to comply with the requirements of that platform.
This may include:
Event creation standards
Ticketing procedures
Reporting requirements
Customer communication requirements
Payment processing requirements
Data collection requirements
Fleurieu Food Festival reserves the right to nominate or change approved ticketing platforms from time to time.
Where the festival facilitates ticket sales through a centralised ticketing platform, event organisers remain responsible for:
Event delivery
Customer service
Refund decisions
Event communications
Compliance with applicable laws
14G. Independent Business Relationship
Participation in Fleurieu Food Festival does not create any partnership, agency, joint venture, employment or representative relationship between Fleurieu Food Festival and participating organisers.
Organisers participate as independent businesses and operators.
Nothing in these Terms and Conditions authorises an organiser to:
Act on behalf of Fleurieu Food Festival
Enter into agreements on behalf of Fleurieu Food Festival
Make representations on behalf of Fleurieu Food Festival
Create obligations for Fleurieu Food Festival
Organisers are solely responsible for their business operations, financial obligations, staffing, taxation, licensing and regulatory compliance.
14H. Festival Reporting and Data Collection
Organisers agree to reasonably assist Fleurieu Food Festival with festival evaluation, tourism reporting and funding acquittal requirements.
Upon request, organisers may be required to provide information including:
Ticket sales data
Attendance numbers
Visitor origin data
Occupancy information
Economic impact information
Customer feedback
Media outcomes
Any commercially sensitive information will be treated confidentially and aggregated where appropriate for reporting purposes.
Failure to provide requested reporting information may impact eligibility for future participation in Fleurieu Food Festival programs.
14I. Reputation and Brand Protection
Organisers must not engage in conduct that may damage the reputation, goodwill or public perception of Fleurieu Food Festival, Fleurieu Peninsula Tourism, funding partners, sponsors or participating businesses.
Fleurieu Food Festival reserves the right to remove any organiser, event, listing or promotional material that it reasonably believes:
May damage the reputation of the festival
Creates public controversy inconsistent with festival objectives
Is misleading or deceptive
Creates legal or regulatory risk
Is inconsistent with the values of the festival
Any such decision shall be made at the sole discretion of Fleurieu Food Festival.
15. Indemnity
The organiser agrees to indemnify and hold harmless:
Fleurieu Food Festival
Fleurieu Peninsula Tourism
Festival board members
Staff
Contractors
Volunteers
Sponsors
Partners
from any claims, liabilities, damages, losses, costs or expenses arising from:
Event delivery
Negligence
Regulatory breaches
Personal injury
Property damage
Failure to obtain licences or permits
Breach of these Terms and Conditions
16. Limitation of Liability
To the fullest extent permitted by law, Fleurieu Food Festival and Fleurieu Peninsula Tourism are not liable for:
Financial losses
Lost profits
Lost ticket revenue
Event cancellations
Adverse weather impacts
Business interruption
Reputational damage
Marketing outcomes
Attendance outcomes
Sponsorship outcomes
Participation is undertaken at the organiser's own risk.
17. Force Majeure
Fleurieu Food Festival shall not be liable for any failure or delay arising from circumstances beyond reasonable control, including:
Extreme weather
Bushfire
Flood
Pandemic
Public health emergency
Government restrictions
Utility failures
Venue closures
Industrial action
Civil disturbances
Participation fees remain non-refundable unless otherwise determined by Fleurieu Food Festival.
18. Removal from the Festival
Fleurieu Food Festival reserves the right to remove an organiser, event or business from the festival program where:
False or misleading information has been supplied
Fees remain unpaid
Insurance requirements are not met
Regulatory compliance cannot be demonstrated
Behaviour damages the reputation of the festival
These Terms and Conditions are breached
No refund of participation fees will be provided in such circumstances.
19. Governing Law
These Terms and Conditions are governed by the laws of South Australia.
Any dispute arising from participation in Fleurieu Food Festival shall be subject to the exclusive jurisdiction of the courts of South Australia.
20. Amendments
Fleurieu Food Festival may amend these Terms and Conditions at any time.
The most current version will be published on the official festival website.
Continued participation in the festival constitutes acceptance of any updated Terms and Conditions.
